Terms of Service

By accessing and using Runox (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated terms.

Runox provides game server hosting services, including but not limited to Minecraft servers, with plans to expand to other games and Node.js application hosting. The Service allows users to:

• •Create and manage game servers
• •Configure server settings and resources
• •Access server console and file management
• •Schedule automated tasks and backups
• •Monitor server performance and resource usage

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

To use our Service, you must:

• •Be at least 16 years of age, or have parental/guardian consent
• •Provide accurate, current, and complete registration information
• •Maintain and promptly update your account information
• •Maintain the security of your password and account
• •Accept responsibility for all activities that occur under your account
• •Notify us immediately of any unauthorized use of your account

You are prohibited from creating an account on behalf of another person or entity without proper authorization. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

You agree not to use the Service to:

• •Violate any applicable local, national, or international law or regulation
• •Infringe upon or violate our intellectual property rights or the intellectual property rights of others
• •Transmit, distribute, or store material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• •Host or distribute malware, viruses, worms, or any other malicious code
• •Engage in any form of DDoS attacks or other network disruption
• •Attempt to gain unauthorized access to other systems or networks
• •Use the Service for cryptocurrency mining without explicit written permission
• •Resell or redistribute the Service without written authorization
• •Host content that violates the DMCA or equivalent EU directives
• •Engage in activities that result in excessive resource usage affecting other users

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

While we strive to provide reliable service with maximum uptime, we do not guarantee uninterrupted access to the Service. We aim for 99% uptime but are not liable for:

• •Scheduled maintenance (with advance notice when possible)
• •Emergency maintenance or security updates
• •Issues caused by factors beyond our control (force majeure)
• •Third-party service failures (data centers, network providers)
• •Issues caused by user error or violations of the Acceptable Use Policy

While we provide backup features, you are solely responsible for maintaining your own backups of your server data. We strongly recommend regular backups of all important data.

We are not responsible for any data loss that may occur due to:

• •User error or accidental deletion
• •Server failures or hardware malfunctions
• •Security breaches affecting your account
• •Service termination or account suspension
• •Any other circumstances beyond our reasonable control

The Service and its original content, features, and functionality are owned by Runox and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the content you upload or create using the Service. By using the Service, you grant us a limited license to host, store, and display your content solely for the purpose of providing the Service to you.

To the maximum extent permitted by applicable law, in no event shall Runox, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• •Loss of profits, data, use, goodwill, or other intangible losses
• •Damages resulting from unauthorized access to or use of our servers
• •Damages resulting from any conduct or content of any third party
• •Damages for loss of business interruption

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

You may cancel your account at any time through the dashboard or by contacting support. Upon cancellation:

• •Your access to the Service will be terminated
• •Your servers will be stopped and deleted after 7 days
• •All data associated with your account will be permanently deleted after 30 days
• •You remain responsible for any charges incurred up to the cancellation date

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed and construed in accordance with the laws of Spain and the European Union, without regard to its conflict of law provisions.

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof, the parties shall first attempt to settle the dispute through good faith negotiation.

If negotiation fails, EU consumers have the right to use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts of Spain.

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR). Your rights under GDPR include:
